Honestly, nobody can tell you over the phone. It depends on the severity and permanence of your injuries, your medical expenses and lost income, how clear fault is, your own share of fault, and the single biggest limiter, how much insurance coverage actually exists. A claim worth a million dollars against a driver carrying $25,000 in coverage may only reach the available policies. We look at all of it before we give you a range.
For motor vehicle injury claims, two years from the date of the crash or from the last PIP payment made on your behalf, whichever is later. That is longer than Kentucky's general one-year personal injury deadline, but it is easy to misjudge, and the exceptions are fact-specific. Wrongful death claims run on shorter and more complicated deadlines. If you are unsure how much time is left, call us today rather than next month.

Usually yes. Kentucky is a choice no-fault state, so unless you rejected it in writing, your own Personal Injury Protection coverage pays first for medical bills and lost wages, with basic PIP at $10,000. Using your PIP is not "suing yourself" and it does not stop you pursuing the at-fault driver once you clear the tort threshold.

You may still recover. Kentucky follows pure comparative fault, so there is no percentage that automatically bars you, unlike states that cut you off at 50 or 51 percent. Your damages are reduced by your share of the blame. This is exactly why adjusters push for a recorded statement early, and why it is worth talking to a lawyer before you give one.

Kentucky does not require you to carry it, but every insurer has to offer it, and if you bought it, it can cover medical bills, lost wages, lost earning capacity and pain and suffering when the at-fault driver cannot.
