Common questions
What People Ask A Personal Injury Lawyer
What does a personal injury lawyer cost?
We take these cases on a contingency fee, so there is no upfront fee or cost to you and no charge for the initial consultation. We are paid a percentage of the recovery, and if we do not recover money for you, you owe us no attorney fee. The percentage and how case costs are handled are set out in a written fee agreement you read and sign before we represent you.
Do I actually have a case?
That is the question the consultation answers, at no cost to you. Broadly it comes down to four things: somebody had a responsibility to be careful, they were not, their carelessness is what hurt you, and you are out real money or real health because of it. If one of those is missing we will tell you, because a claim that cannot be proved helps neither of us.
How much is my case worth?
Honestly, nobody can tell you over the phone. It depends on the severity and permanence of your injuries, your medical expenses and lost income, how clear fault is, your own share of fault, and the single biggest limiter, how much insurance coverage actually exists. A claim worth a million dollars against someone carrying $25,000 in coverage may only reach the available policies. We look at all of it before we give you a range.
How long do I have to file in Kentucky?
It depends on the type of claim, and the difference is large. Motor vehicle injury claims run two years from the crash or the last PIP payment, whichever is later. Kentucky's general personal injury deadline is one year. Wrongful death runs on its own rules. Getting this wrong ends a claim entirely, so call us before you assume which one applies to you.

What if the accident was partly my fault?
You may still recover. Kentucky follows pure comparative fault, so there is no percentage that automatically bars you, unlike states that cut you off at 50 or 51 percent. Your damages are reduced by your share of the blame. This is exactly why adjusters push for a recorded statement early, and why it is worth talking to a lawyer before you give one.

Should I accept the insurance company's first offer?
Not before someone has looked at what your treatment is likely to cost from here. A first offer is made before anyone knows whether your injuries are permanent, and accepting it usually ends the claim for good. There is no cost to having us look at it.
Do you handle car wrecks and other accidents?
Yes. Our Kentucky personal injury lawyers handle car wrecks and auto accidents, truck and motorcycle crashes, rideshare accidents, and premises and product injuries. Whether you search for an accident lawyer, an injury attorney or a personal injury law firm, the first call is free, and we represent injured people across Kentucky from our offices in Lexington and Bowling Green.
