Common questions
What Riders And Drivers Ask Us
Whose insurance pays after an Uber or Lyft crash?
It depends on what the driver's app was doing at the moment of the crash, which is why this is rarely as simple as an ordinary collision. There are three periods: app off, app on and waiting for a request, and a ride accepted or in progress. Each period has different coverage available, and the rideshare company and the driver's personal insurer will each have a view on which one applied.
We get the trip data early, because the period is a question of fact and the record that proves it belongs to the company you are claiming against.
How much coverage is there while a driver is waiting for a request?
Less than most people assume. While drivers are waiting for ride requests, Lyft offers reduced third party liability coverage of $50,000 per person for bodily injury, $100,000 per accident for bodily injury, and $25,000 per accident for property damage. Once a ride is accepted the available coverage is substantially higher.
That gap is why the period matters so much, and why establishing it is the first thing we do.
Coverage tiers as published by Lyft and stated on mvmlaw.com.
I was the passenger. Am I making a claim against the driver?
Usually you are making a claim against whichever insurer covers the crash, which may be the rideshare company's policy rather than the driver personally. Passengers are rarely at fault for anything, which tends to make these the most straightforward claims to establish and the most contested on value.
What does a rideshare accident lawyer cost?
We take these cases on a contingency fee, so there is no upfront fee or cost to you and no charge for the initial consultation. We are paid a percentage of the recovery, and if we do not recover money for you, you owe us no attorney fee. The percentage and how case costs are handled are set out in a written fee agreement you read and sign before we represent you.
How long do I have to file in Kentucky?
For motor vehicle injury claims, two years from the date of the crash or from the last PIP payment made on your behalf, whichever is later. That is longer than Kentucky's general one-year personal injury deadline, but it is easy to misjudge, and the exceptions are fact-specific. If you are unsure how much time is left, call us today rather than next month.

Do I have to use my own insurance first?
Usually yes. Kentucky is a choice no-fault state, so unless you rejected it in writing, your own Personal Injury Protection coverage pays first for medical bills and lost wages, with basic PIP at $10,000. Using your PIP is not “suing yourself” and it does not stop you pursuing the at-fault party once you clear the tort threshold.
KRS 304.39-020, 304.39-060
When can I sue the at-fault driver for pain and suffering?
Only once your injuries clear Kentucky's tort threshold. That means more than $1,000 in medical bills, or a permanent disfigurement, a broken weight-bearing bone, a compound or comminuted fracture, the loss of a body member, a permanent injury, or death. Until then, your own PIP coverage pays first for medical bills and lost wages. Whether your crash clears the threshold is one of the first things we check, and the call is free.

Do you handle both Uber and Lyft accident claims?
Yes. Our Kentucky rideshare accident lawyers handle Uber accident and Lyft accident claims for passengers, for rideshare drivers, and for people hit by a rideshare vehicle, across Kentucky from our offices in Lexington and Bowling Green. The first call is free, and we will tell you honestly whether you appear to have a claim.
